KINOS Terms of Service

These terms are the agreement between you and KINOS SDN. BHD. (Company No. [SSM NO.]), [REGISTERED ADDRESS], Malaysia ("KINOS", "we", "us"). They apply to the KINOS app, our website (kinos.my) and anything you buy from us. By creating an account or using KINOS, you agree to them. Please also read our Privacy Notice and Refund Policy.
1. Who can use KINOS
- You must be 18 or older to create an account.
- You are responsible for keeping your sign-in details safe and for what happens in your account.
- Tell us straight away at [email protected] if you think someone else has used your account.
2. What KINOS is
KINOS is a private place for a family to keep the memories of a child's life, from pregnancy onwards, in a book. The account owner decides who else can see and add to the book.
KINOS is not a medical service. Ultrasound images and health records in KINOS are keepsakes and personal reminders. They are not medical records, and nothing in KINOS is medical advice. Always ask your doctor about your or your child's health.
We are still building KINOS. Features may change, and some may be marked as early or trial features.
3. Your memories are yours
- You own the photos, videos, notes and other content you add ("your content").
- You give us permission to store, copy, process and display your content only so that we can run KINOS for you. That includes backups, thumbnails, building your book and export, and showing it to the family members you choose. This permission ends when your content is deleted, apart from backup copies, which are deleted within the time in our Privacy Notice.
- You can export your content, free, at any time, including after a paid plan ends.
4. Family members
- The account owner invites family members and chooses their role, which sets what each person can see, add or change.
- The owner can change a family member's role or remove them at any time.
- Everyone who uses KINOS must follow these terms.
- If the owner deletes the book or their account, what family members added to that book is deleted too.
5. What you must not do
Do not use KINOS to:
- upload content you have no right to share, or photos of other people's children without their parents' permission;
- upload anything illegal, harmful or hateful, or anything that sexualises a child. We may remove such content and close the account, and we report content that sexualises a child to the authorities;
- harass anyone, pretend to be someone else, or collect other users' information;
- break, overload or try to get around the security of KINOS, or copy or resell KINOS.
6. Plans and payment
- Free plan: includes 1 GB of storage.
- Paid plans, when they become available: Premium (100 GB) and Premium Plus (200 GB). The price, what is included and any taxes are shown before you pay.
- Buying in the app: payment is handled by Apple or Google under their terms. Manage or cancel the subscription in your App Store or Google Play account.
- Buying on our website: payment is handled by Billplz. Manage or cancel in the app, or by emailing us.
- Renewal: subscriptions renew automatically at the end of each period until you cancel. Website subscriptions paid by online banking (FPX) do not renew automatically; we will remind you before they end. For annual plans, we will remind you before the renewal date. When you cancel, you keep your plan until the end of the period you have paid for.
- Price changes: we will tell you at least 30 days before a new price applies to your subscription, and you can cancel before it does.
- Founding plan: the first 100 families who buy it pay the Founding price for Premium. The price stays the same for as long as the subscription renews without a break. If the subscription ends (you cancel, or a failed payment is not fixed within the grace period), a new subscription is at the normal price.

7. Storage
- If you reach your storage limit, you cannot add more until you free up space or change plan. We do not delete your memories because you reached a limit.
- If a paid plan ends, your memories stay. We never delete your memories because a plan ended. You can still view and export everything, and you can add more once you are under the Free limit, or when you renew.
- For 12 months after a paid plan ends, content over the Free limit is still kept with two separate providers. After that, it is kept with one provider until you renew.
8. Classes and activities from merchants
- KINOS may list classes and activities run by independent merchants. When you book, KINOS takes the payment on the merchant's behalf. The merchant provides the class or activity and is responsible for it.
- Each booking shows the price, what is included and the merchant's class rules (such as age). Cancellations and refunds follow our Refund Policy.
- You are responsible for supervising your child at the activity unless the merchant says otherwise.
9. Clinics
If you connect a clinic, the clinic can send ultrasound images into your book. The clinic is responsible for its medical services. KINOS is responsible only for keeping the images in your book.
10. Your child's book in the future
KINOS is designed so that, one day, a child can receive their own book. Before we offer this, we will explain how it works and ask the parents who hold the account for their consent.
11. Ending your account
- You can delete your account at any time in the app (see kinos.my/support). Deleting your account does not cancel a subscription bought through Apple or Google; cancel it there first.
- We may suspend or close an account that seriously or repeatedly breaks these terms, or where we must do so by law. Unless the law or safety prevents it, we will tell you first and give you time to export your content.
- If we ever decide to close KINOS, we will give you at least [90] days' notice so you can export everything.
12. Our responsibility to you
- We work hard to keep your memories safe, including keeping originals with two separate providers (section 7 explains what changes if a paid plan ends). No online service can promise it will never fail, so we encourage you to export your book from time to time.
- Nothing in these terms takes away your rights under the Consumer Protection Act 1999 or any other law that protects consumers.
- To the extent the law allows, we are not responsible for losses that we could not reasonably foresee, and our total responsibility to you is limited to the amount you paid us in the 12 months before the claim.
13. Changes to these terms
If we change these terms in a way that matters, we will tell you in the app or by email at least 30 days before the change takes effect. If you do not agree, you can stop using KINOS and export your content.
14. Disputes and law
These terms are governed by the laws of Malaysia. If something goes wrong, please contact us first at [email protected] and we will try to fix it. You may also bring a claim to the Tribunal for Consumer Claims Malaysia or the Malaysian courts.
If you downloaded the app from the App Store, Apple's standard licence terms for apps also apply, and Apple is not responsible for KINOS or its content.
